Article 21 of the Animal Protection Law No. 5199 states that a driver who hits and harms an animal must take it to the nearest veterinarian or treatment unit or ensure that it is taken. If this obligation is violated, administrative fines are imposed on these people. You can file a complaint against these people with the Provincial Directorate of Agriculture and Forestry and the prosecutor's office.
You can also file a complaint for the crime of Endangering Traffic Safety by Negligence under Article 180 of the Turkish Penal Code and for the crime of damaging property under Article 151/2 of the Turkish Penal Code, especially if the animal hit by the car is an animal you feed and you are its owner.

The municipalities are responsible for collecting, neutering, vaccinating, providing necessary medical care and marking of stray or weakened animals, and returning them to where they were taken. In this context, all municipalities must first return animals within their borders to the environment they were taken from after providing treatment, necessary care and vaccination. Metropolitan municipalities are also responsible for animals within their borders. Metropolitan municipalities mostly work in coordination with local municipalities. For this reason, you can report the injured animal to the local municipality or metropolitan municipality where you found it.

The living environment of animals is defined in Article 3 of the Animal Protection Law No. 5199. According to this definition; the place where an animal or a group of animals live naturally is the living environment. Here, without making a distinction between private property and public space, every place where animals instinctively exist and continue their lives is their natural living environment. In Article 4 of the same law, the basic principles regarding the protection of animals and their comfortable living are regulated. Accordingly; all animals are born equal and have the right to live. The lives of ownerless animals should be supported just like animals with owners. Necessary measures should be taken to protect, supervise, care for and keep animals away from mistreatment.
According to its first article, "Intentionally mistreating animals, treating them cruelly and ruthlessly, beating them, leaving them hungry and thirsty, exposing them to extreme cold or heat, neglecting their care, and causing physical and psychological pain." are prohibited acts.
In the face of these legal regulations, the protection of the life and freedom of life of all animals is a right for them and an obligation for humans. It should not be forgotten that the natural habitats of animals have been taken away from them with the reinforced concrete structures we have built to build our own living spaces. In this context, you can send a warning letter to the site management and people who oppose you feeding the animals on the site, reminding them of these issues. In fact, adding a reminder to your warning letter that if there are problems caused by the management and/or the site residents, structures and uses that are against the management plan or zoning plan, these findings will be made and reported to the relevant institutions through a legal right to complain, and a lawsuit can be filed to eliminate the violations, is a very effective way to make these people step back.
You can complain to the Provincial Directorate of Agriculture and Forestry in the province you live in (on the grounds of non-compliance with the principle regulation and prohibited situations within the scope of Law No. 5199) and to the prosecutor's office (within the scope of the crime of disturbing the peace and tranquility of people regulated in Article 123 of the Turkish Penal Code) in order to warn and fine those who act contrary to the Animal Protection Law No. 5199. However, for an effective complaint; you should not be complacent in the sense that you have filed a complaint petition and done what was necessary, and you should constantly follow the outcome of your complaint petition.

If you see an animal that has been subjected to violence, torture or rape, you can report it to the municipality. The veterinary services of the municipalities are responsible for the treatment, care and rehabilitation of these animals.
Article 14 of the Animal Protection Law No. 5199 clearly prohibits deliberately mistreating animals, committing cruel and merciless acts, beating them, leaving them hungry and thirsty, exposing them to extreme cold and heat, neglecting their care, causing physical and psychological pain, having sexual intercourse with animals, and torturing them. These individuals who mistreat animals can be reported to the Provincial Directorates of Agriculture and Forestry, which are responsible for taking the necessary measures for the protection of animals. In this way, you can ensure that these individuals who hurt and harm these animals are given administrative fines for their unlawful actions, and that the animals in their possession are confiscated.
At the same time, it is possible that these behaviors that are subjected may have counterparts as crimes in the Turkish Penal Code. For example, in case of harming an owned animal, it can be found in the crime of damaging property in Article 151/2 of the Turkish Penal Code; in case of rape, it can be found in the crime of indecent acts in Article 225 and obscenity in Article 226; in case of poisoning of animals, it can be found in the crimes of deliberately polluting the environment in Article 181 and negligently polluting the environment in Article 182; in case of shooting animals with a firearm, it can be found in the crime of deliberately endangering public safety in Article 170; and in case of tying an animal to the back of a vehicle and dragging it in traffic, it can be found in the crime of endangering traffic safety in Article 179. It should be emphasized that; If the animal subjected to the above acts is not your registered animal or an animal you adopted from an institution, but is an animal you feed and care for on the street, do not forget that this animal will also be considered as an owned animal within the scope of the Turkish Penal Code and you can file a criminal complaint for damaging property under TCK 151/2 by claiming that this animal is an owned animal.
For this reason, reporting animals subjected to violence, torture, rape, etc. to the police and filing a criminal complaint with the prosecutor's office will ensure that the people who commit these acts will face heavier penalties than administrative fines. In such cases, it will be beneficial to file your complaint petition and follow-up with large groups and different institutions.

The sale of domestic and ornamental animals is regulated by law. The Regulation on the Production, Sale, Sheltering and Training Places of Domestic and Ornamental Animals regulates the conditions such as the features that pet shops must have and how domestic and ornamental animals will be exhibited.
The opening and licensing of pet shops are subject to the permission of the Ministry of Agriculture and Forestry, and their inspections are carried out by the Ministry through the Provincial Directorates of Agriculture and Forestry in the provinces.
In addition, municipalities are responsible for organizing training for pet shop owners. At the same time, the veterinary departments of the municipalities are responsible for inspecting pet shops in terms of health conditions.
Therefore, if you see anything that is against the legislation or if animals are mistreated, you should apply to the municipal veterinary affairs directorate or the Provincial Directorate of Agriculture and Forestry with your complaint petition, attaching your evidence.

Fighting animals with other living animals is clearly prohibited in the Animal Protection Law. If you encounter such a situation, you can complain to the Provincial Directorate of Agriculture and Forestry, municipalities and the prosecutor's office to be given an administrative fine.
At the same time, in Article 228 of the Turkish Penal Code, providing a place and opportunity for gambling is regulated as a crime. In the same article, in the application of the Penal Code, gambling is defined as games that are played for the purpose of profit and where profit and loss depend on luck. In return for this crime, those who commit this crime are given a prison sentence. When you witness such an event, you can file a criminal complaint with the police or the prosecutor's office in accordance with this article of the Penal Code.

Everyone is responsible for taking the necessary precautions to protect, monitor, care for and prevent animals from being mistreated. The probability of a trapped animal going hungry, thirsty, suffering and getting hurt is quite high. Therefore, if the police and fire department refuse to rescue the trapped animal because it is private property, try to put pressure on it. For this, contact the prosecutor's office and the Provincial Directorate of Agriculture and Forestry. There are many examples where the prosecutor's office has taken action and the door has been opened in their presence and private property has been entered.
Institutions can often be slow to act, but if you insist and put the pressure on them to act, they will have to do what is necessary. Don't be afraid to use social media when you need to put that kind of pressure on them. When there is an effective public opinion, they will have to take action.

It is one of the basic principles of the Animal Protection Law No. 5199 that all animals are born equal and have the right to live. You can complain to the Provincial Directorate of Agriculture and Forestry, which is responsible for monitoring whether the provisions of this Law are complied with.
In addition, since it is possible that these people use firearms in a way that is dangerous to people's life, health or property or that can create fear, anxiety or panic in people, you can file a criminal complaint with the prosecutor's office for the crime of intentionally endangering public security, which is regulated in Article 170 of the Turkish Penal Code, and for the crime of violating Law No. 6136 (Law on Firearms, Knives and Other Tools) since it is highly probable that the people who engage in such a crime are in illegal possession of the weapons.

In the Animal Protection Law No. 5199, it is clearly forbidden to intentionally mistreat animals, to treat them cruelly and ruthlessly, to beat them, to leave them hungry and thirsty, to expose them to extreme cold and heat, to neglect their care, and to inflict physical and psychological pain. You should report the situation to the Provincial Directorate of Agriculture and Forestry, which is responsible for monitoring whether this law is being followed, and to complain about these people.
In addition, it is a crime to release waste or residues into the soil, water or air in a way that will harm the environment. In this context, you can file a criminal complaint with the prosecutor's office against those who pollute the environment by harming animals with toxic waste, for the crimes of intentional pollution of the environment regulated in Article 181 and negligent pollution of the environment regulated in Article 182 of the Turkish Penal Code.
Again, even if the poisoned animals do not have a certificate, if the animal you feed and care for is owned, you can file a criminal complaint for the crime of damaging property under Article 151/2 of the Turkish Penal Code, on the grounds that it is an animal owned by you.

The rules for the slaughter of animals are also regulated in the Animal Protection Law No. 5199. Accordingly; It is done immediately, without frightening or scaring the animal, in a way that causes the least pain, in compliance with hygienic rules and in accordance with the procedure, taking into account the special conditions required by religious rules. It is ensured that the slaughter of animals is carried out by qualified persons. With this regulation, it is aimed to prevent the mistreatment of slaughtered animals and it is stipulated that administrative fines will be given to those who do not comply. In this context, you can complain to the Provincial Directorate of Agriculture and Forestry and the municipality about those who do not comply with these rules.

If you see an animal that has had an accident, it may be a problem to intervene on your own. Because these animals may become anxious due to the accident and become aggressive. However, if it is possible to intervene on your own, you can try this.
According to the Animal Protection Law No. 5199, you can apply to the nearest municipality to benefit from the veterinary services of the municipalities. Injured street animals are taken in by the municipalities and treated and rehabilitated. If you call 153 in this regard, an intervention will be made. It is important to note that you may need to call 153 more than once and we recommend that you follow up on the fate of the animal taken.

The Animal Protection Law No. 5199 imposes the obligation to take the necessary measures to protect, supervise, care for and keep animals away from mistreatment. In this context, municipalities are responsible for the care, treatment and rehabilitation of homeless and weakened animals. Veterinary services of municipalities are required to treat animals within their own municipal borders. However, in some municipalities, although it is mandatory, there may be situations such as not having a unit to provide veterinary services or veterinarians not being equipped to care for poultry. In this case, you can contact the Provincial Directorate of Agriculture and Forestry and get support.

The authority to inspect whether the provisions of the Animal Protection Law No. 5199 are being followed and to impose administrative fines belongs to the Provincial Directorate of Agriculture and Forestry on a provincial basis. Other prohibitions such as deliberately mistreating animals, committing cruel and merciless acts, beating them, leaving them hungry and thirsty, exposing them to extreme cold and heat, neglecting their care, causing physical and psychological pain, etc. are listed in the law. You can complain to the Provincial Directorate of Agriculture and Forestry about entertainment centers that violate these prohibitions and mistreat animals.
There is a separate regulation for zoos in the law. Accordingly, business owners and municipalities are obliged to organize and have zoos arranged in the most appropriate way for the natural habitat. Those who do not comply with this obligation are given administrative fines for each animal they keep in poor conditions in zoos. At the same time, you can also complain to the local government for the closure and cancellation of licenses of places operating in this way.
However, to solve this problem radically, do not go to zoos and warn those who do. Remember that elephants, giraffes, lions and monkeys do not belong in miniature cages disguised as natural habitats in your city.

Article 38 of the Road Transport Regulation was amended on January 10, 2020. Accordingly; pets such as cats, dogs (except for those posing a danger) and birds (goldfinches, budgies or canaries) with vaccination certificates can be carried on the lap of the passenger or in front of the seat where the animal is sitting, outside the compartment reserved for carrying luggage, provided that their special cages are locked. In necessary cases, special trips can be arranged for the transportation of pets inside the vehicle without passengers. 2 warnings will be given to authorization certificate holders who do not comply with this paragraph.

Experts consider that children committing violence against animals and causing harm are generally considered to be domestic violence themselves, or witnessing violence or abuse. Basic principles regarding the protection of children's rights are listed in the Child Protection Law No. 5395, such as the regulation of animal rights. The persons who can request protective and supportive measures to be taken in the areas of counseling, education, care, health and shelter, primarily to ensure that the child is protected in his/her own family environment, are listed in Article 7 of the Child Protection Law. Therefore, you can apply to the prosecutor's office with a petition explaining the situation.
Provincial Directorates of Family, Labor and Social Services are responsible for carrying out and coordinating the Ministry's protective, preventive, educational, developmental, guidance and rehabilitative social service activities for families, society and children. In this context, you can apply with a petition for the Provincial Directorates to take the necessary precautions and implement programs that will provide education and rehabilitation for these individuals.
In Article 16 of the Animal Protection Law No. 5199, organizing educational activities regarding animal love, protection and survival is listed among the duties of the Provincial Animal Protection Board. You can also request the Provincial Animal Protection Board to organize and popularize these activities for children.

The principle that local governments, in cooperation with voluntary organizations, establish animal shelters and hospitals to protect homeless and weakened animals, provide their care and treatment, and provide training is regulated by law. For this reason, municipalities must comply with this obligation. Provincial Directorates of Agriculture and Forestry are responsible for inspecting whether the law is being followed and taking the necessary measures. In this context, you can complain to the Provincial Directorate of Agriculture and Forestry to take the necessary measures, inspect, and take action to impose administrative fines due to municipalities acting contrary to their legal obligations.
At the same time, you can file a criminal complaint with the prosecutor's office against public officials who avoid caring for injured animals despite being legally obliged to do so, for the crime of neglect of duty in Article 257 of the Turkish Penal Code, due to their negligence or delay in performing their duties.

The purpose of the Animal Protection Law No. 5199 is defined as ensuring that animals live comfortably and are treated well and appropriately, ensuring that animals are protected in the best way against pain, suffering and torment, and preventing all kinds of victimization. Similarly, it is also among the basic principles that all animals are born equal and have the right to live within the framework of this law, no discrimination is made between animals, and the obligation to take the necessary measures to protect, supervise, care for and keep all animals away from mistreatment is imposed. Within the framework of this law, municipalities are obliged to provide treatment for all animals, including birds.
However, in some municipalities, although it is mandatory, there may be situations where there is no unit to provide veterinary services or veterinarians are not equipped to care for poultry. In this case, you can contact the Provincial Directorate of Agriculture and Forestry and get support.

The Implementation Regulation on the Protection of Animals stipulates that municipalities are responsible for the care, vaccination, marking and registration of stray animals, especially dogs and cats, in their regions and neighborhoods, their neutering and returning to the environment they were taken from. The municipality must take measures to carry out these activities with the coordination of local animal protection officers, voluntary organizations and municipal veterinarians.
In this context, you can try to get information by contacting volunteers or organizations in your region and municipality veterinarians. However, if the animals in your neighborhood are not collected for care, rehabilitation, or neutering purposes, it will be against the law and regulations. In this case, you can complain to the Provincial Directorate of Agriculture and Forestry, which is responsible for inspection.
You can also file a criminal complaint with the prosecutor's office for the crime of abuse of office regulated in Article 257 of the Turkish Penal Code, if the municipality acts contrary to the reasons for gathering animals determined by law and does not return the animals to the environment from which they were taken.

In case of mistreatment of an owned animal, you can file a complaint with the Provincial Directorate of Agriculture and Forestry. Article 24 of the Animal Protection Law No. 5199 and Articles 49 and 50 of the Implementation Regulation on the Protection of Animals regulate the conditions for keeping an animal rights violation report and seizing animals. Accordingly; if a violation of the acts specified in the Animal Protection Law No. 5199 is detected during the inspection to be carried out by the relevant inspection officers, the bad conditions are recorded in the report. Administrative fines are imposed on those who are determined by the inspection officers to have seriously neglected the care of the animals they keep or to have caused them pain, suffering or harm, and these animals are seized by the directorate. It is important for you to be present as the complainant during the inspection so that there is no deficiency in the detection of bad conditions and that they are recorded in the report. The animals seized as a result of the inspection are delivered to you or the shelters with a report.

Shelters/Temporary shelters are defined as facilities where animals are rehabilitated and temporarily stay during this period until they are adopted or returned to the environment they were taken from. Veterinarians are responsible for ensuring that these facilities operate in accordance with current legislation, together with the institutions, organizations and legal entities they are affiliated with, and that animals are accepted to these places and cared for under appropriate conditions, records are kept, animals are vaccinated, disinfected, neutered and marked, tools and materials are cleaned and disinfected, and measures are taken to prevent waste and residues from harming the environment and public health. In this context, you can complain to the municipality where they are located about the responsible veterinarians and shelter staff.
You can notify the Provincial Directorate of Agriculture and Forestry, which is responsible for inspecting whether the Animal Protection Law is being followed, to conduct inspections, take the necessary measures and have administrative fines imposed.
You can file a criminal complaint with the prosecutor's office against the veterinarians and shelter staff who are responsible for the shelters/temporary shelters operating in accordance with the legislation, for the crime of abuse of office in Article 257 of the Turkish Penal Code, due to their negligence in their duties and acting contrary to the requirements of their duties.

According to Article 5 of the Animal Protection Law No. 5199, animal owners are obliged to take precautions to prevent environmental pollution and possible harm and discomfort to people caused by the animals they own. In this context, you must take precautions to prevent behaviors that will violate neighborhood law. However, if you violate these obligations, you may be subject to administrative fines.
However, even if precautions are taken, it is often seen that animal owners are subject to these complaints. First of all, you should know that the evacuation of pets is only possible by filing a lawsuit. Only this way can intervention be made to owned animals. Even if the relevant inspection officer requests the evacuation of your animals upon complaint, this will be against the law. In this case, it should be reported that a complaint will be filed against the relevant public officials for abuse of office and it should be prevented from acting against the law.
You may be fined for noise. However, even in this case, you can object to the administrative fine. In order for an administrative fine to be imposed for noise, according to the Regulation on the Protection of Animals, certain sound levels must be exceeded and this determination must be made by an expert witness. An administrative fine issued without an expert witness's determination is not valid. However, it is mandatory to file an annulment lawsuit to have the fine annulled.
If you are acting in accordance with your legal obligations but are constantly being complained about, you can file a criminal complaint with the prosecutor's office for the crime of disturbing the peace and tranquility of people as regulated in Article 123 of the Turkish Penal Code, and for the crime of abuse of office against the person who initiated the criminal action, excluding the annulment case in case of an unjust penalty.

Article 4 of the Animal Protection Law No. 5199 regulates the basic principles regarding the protection of animals and their comfortable living. Accordingly, all animals are born equal and have the right to live. The lives of ownerless animals should be supported just like those of animals with owners. Necessary measures should be taken to protect, supervise, care for and keep animals away from mistreatment.
According to Article 14 of the same law, "Intentionally mistreating animals, treating them cruelly and ruthlessly, beating them, leaving them hungry and thirsty, exposing them to extreme cold or heat, neglecting their care, and causing physical and psychological pain." are prohibited acts.
Protecting the freedom of life of all animals is a right for them and protecting animals is also a responsibility for people. Necessary measures must be taken for the protection and care of animals, etc. However, while meeting these needs, it is certain that the law of neighbors should not be violated and measures should be taken in a way that will not cause environmental pollution. In this context, meeting the nutritional needs of animals living on the street is in accordance with the law. Continuously complaining about those who feed animals on the street and subjecting them to verbal harassment in opposition to this constitutes the crime of disturbing the peace and tranquility of persons regulated in Article 123 of the Turkish Penal Code. Unfortunately, those who feed animals on the street are often subject to threats and insults. If you have encountered these actions, insult is defined as a crime in Article 125 of the Turkish Penal Code and threat is defined as a crime in Article 106, and you can complain to the police or file a criminal complaint with the prosecutor's office. In this complaint, you should describe the insults, threats, etc. made and, if any, you should also provide your witnesses and other evidence.
You can also complain to the Provincial Directorate of Agriculture and Forestry to have administrative fines imposed on those who prevent you from feeding, by mentioning the principles and prohibited situations mentioned above within the scope of Law No. 5199.

Here, the management plan should be looked at first. Unless prohibited in the management plan, pets can be kept in the apartment. Despite this, even if it is prohibited to keep pets that are prohibited in the management plan, there is also a court decision that this ban is null and void. (You can review the decision of the Istanbul Anatolian 12th Civil Court of Peace, numbered 2011/1073 Es. 01.03.2013, and the decision of the 18th Civil Chamber of the Court of Cassation, numbered 2014/6465 E. 2014/12547 K. dated 11.09.2014.)
If there is no prohibition in the management plan, according to Article 5 of the Animal Protection Law No. 5199, animal owners are obliged to take precautions to prevent environmental pollution and possible harm and discomfort to people caused by the animals they own. In other words, even if there is no prohibition, we are obliged to take the necessary precautions when keeping pets and we must not disturb our neighbors.
However, whether it is prohibited in the management plan or not, it is mandatory to file a lawsuit for the evacuation of pets. Only this way can intervention be made to owned animals. Other public institutions or individuals cannot intervene. In the event that a public official warns you upon complaint, it will be useful to present the vaccination records and training certificates of your pets, if any. However, let us remind you again that it is not possible to evacuate your pet without a court order.
Article 4 of the Animal Protection Law states that "Domestic animals have the freedom to live in living conditions specific to their species" and Article 3 of the European Convention for the Protection of Pet Animals, to which our country is also a party, states that "No one may abandon a pet.", thus providing the basic principles regarding the right to life of pets.
Within this framework, you can warn your neighbors who are interfering with your pet's freedom of life and universal rights in an unlawful manner. In fact, if you add a reminder to your warning to these people that if there are any situations that are contrary to the management plan of the apartment building and structures that are contrary to the zoning plan, these findings will be made and reported to the relevant institutions through a legal right to complain, and a lawsuit can be filed to eliminate the violations, this may cause these people to back down.
If it continues despite your warnings, you can file a criminal complaint with the prosecutor's office against those who unlawfully interfere with your pet's freedom of life and your peace, for the crime of disturbing the peace and tranquility of people, as regulated in Article 123 of the Turkish Penal Code.
